It's against the Justice Department's interest to have Judge Jackson make an immediate remedy decision because that increases the odds that he would be reversed on appeal. There is a fair chance that experts who have already submitted affidavits in the case will be called as witnesses and there will be a mini-trial that revolves around remedies.

On the surface, the only apparent antitrust problem appears to be the fact that AOL and Time Warner's Roadrunner might be seen as being competing Internet services. But Roadrunner is a pipsqueak of a player compared to AOL's service. It's conceivable they could force the divestiture of Roadrunner. But that's not a big deal.
